Terms and Conditions

These Terms and Conditions (the "Terms") govern your use of Grada (the "App"), an iOS app that lets football fans capture memories of the matches they attend, build a personal "passport" of the stadiums and cities they have visited, and share those memories with friends. Please read them carefully. By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

Our Privacy Policy explains how we handle your personal data and forms part of these Terms.

1. Who we are

Grada is built by a single independent developer. It is not affiliated with, endorsed by, or connected to any football club, league, federation, stadium operator, or Apple Inc.

2. Who can use Grada

• You must be at least 16 years old to use Grada.
• You must be able to enter into a binding contract under the law of your country of residence.
• You may only use Grada for your personal, non-commercial purposes.

3. Your account

• You sign in with Sign in with Apple or Google Sign-In. You are responsible for keeping access to that account secure.
• You are responsible for everything that happens under your account. If you believe someone else has accessed it, contact us immediately.
• You may choose a username. Usernames must not impersonate other people, clubs, or brands, and must not be offensive.
• You can delete your account at any time in the App (Settings → Delete Account). Deletion removes your profile, memories, photos, stamps, and friend connections as described in the Privacy Policy.

4. The service

Grada lets you:

• create Memories of matches and stadium visits, with a photo, an optional ticket photo, match details, notes, and tagged friends;
• collect city stamps and build a football passport that is generated automatically from your Memories;
• connect with friends and share your Memories with them;
• see a limited community feed of memories shared by other fans;
• enter manual fixtures when a match cannot be found in our data.

Grada is currently free to use. We may add, change, or remove features over time, and we may suspend or discontinue the App or parts of it. Where a change materially reduces what you can do with the App, we will try to give you reasonable notice within the App.

5. Your content

"Your Content" means everything you upload or create in Grada: photos, ticket images, notes, manual fixtures, your profile, and any other material.

5.1 You own it

You keep all rights to Your Content. We do not claim ownership of it.

5.2 The licence you give us

So that Grada can work, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, and display Your Content for the purpose of operating and improving the App — for example, showing your Memory to the friends you shared it with, or a limited preview in the community feed. This licence ends when you delete the content or your account, except for copies that remain in routine backups for a short period.

We will never use your photos or Memories in marketing, on social media, or on our website without asking you first, and you can always say no.

5.3 Invite links

You can share a Memory with someone who is not yet your friend through an invite link. Anyone who has the link can see the preview it points to, so only share invite links with people you trust. You can stop sharing by removing the tagged friend or deleting the Memory.

5.4 You are responsible for it

You confirm that:

• you have the right to upload Your Content (for example, you took the photo or have permission from the person who did);
• Your Content does not infringe anyone's copyright, trademark, privacy, or other rights;
• if Your Content shows other people, you have their permission to share it;
• manual fixture details you enter are accurate to the best of your knowledge.

5.5 What is not allowed

You must not upload or share content that:

• is illegal, or promotes illegal activity;
• is sexual, pornographic, or sexually suggestive;
• is hateful, discriminatory, or harasses, threatens, or bullies anyone;
• is violent or glorifies violence, including in a football context;
• contains someone else's personal data, such as tickets showing another person's name or barcode, without their consent;
• is spam, advertising, or unrelated to football memories;
• contains malware, or attempts to interfere with the App or other users.

6. Community rules and moderation

• Memory details are visible only to friends you have accepted. The community feed shows a more limited preview to other users.
• At this time Grada does not pre-screen content before it is shown. We are adding a report function so users can flag content that breaks these Terms.
• If you see content that concerns you, contact us at hello@gradaapp.com. We may remove content and suspend or terminate accounts that violate these Terms, at our reasonable discretion and without prior notice where the violation is serious.
• Be respectful. Rivalry is part of football; abuse is not.

7. Supporting the developer (in-app purchases)

• Grada offers optional "support the developer" tips (for example Coffee, Lunch, Sponsor) as in-app purchases.
• Tips are voluntary donations. They do not unlock features, content, or benefits, and they are not a subscription.
• Payments are processed entirely by Apple under Apple's terms. We never see your payment details. Purchase records are managed through RevenueCat.
• Because a tip provides nothing further to deliver, tips are non-refundable, except where Apple's refund policy or applicable consumer law requires otherwise. Refund requests are handled by Apple.

8. Football data, clubs, and trademarks

• Match fixtures, results, team and competition names, logos, and stadium information are supplied by third-party data providers, currently API-Football. We do not own this data and do not guarantee that it is complete, accurate, or up to date.
• Club names, crests, competition names, and logos are the trademarks and copyrighted works of their respective owners. Grada uses them solely to identify the teams, competitions, and matches you attended. Grada is not affiliated with, sponsored by, or endorsed by any club, league, federation, or data provider, and nothing in Grada is "official".
• Rights holders: if you own rights in a name, logo, or image shown in Grada and object to its use, email hello@gradaapp.com with details of the mark and where it appears. We will review promptly and remove or replace the material where appropriate.
• Grada is not a ticketing, travel, or official information service. Always check kick-off times, venues, and ticket details with the club or official organiser before you travel.

9. Our intellectual property

The App, including its name, icon, design, code, stamps artwork, and text (but excluding Your Content and third-party trademarks), belongs to us and is protected by copyright and other laws. You may use the App only as these Terms allow. You must not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the App, or use automated tools to scrape or extract data from it.

10. Communications

We may send you service messages that are necessary to run Grada — for example about your account, security, or changes to these Terms — by push notification or email. If you signed up to our launch waitlist, we email you about the launch only; every waitlist email includes an unsubscribe link. You can turn push notifications off at any time in your device settings.

11. Feedback

If you send us ideas, suggestions, or bug reports, you agree that we may use them to improve Grada without any obligation to you — and without any obligation to keep them confidential. We are grateful for every one of them.

12. Acceptable use

You agree not to:

• use the App for any unlawful purpose;
• access or attempt to access other users' accounts or data;
• interfere with the App's operation, servers, or security;
• create accounts by automated means or create multiple accounts to evade a suspension;
• misrepresent who you are or your affiliation with any club or organisation.

13. Termination

• You can stop using Grada at any time and delete your account in the App.
• We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the App. Where reasonable, we will tell you why.
• Sections 5.2 (for backup copies), 8, 9, 11, 14, 15, and 17 continue to apply after termination.

14. Disclaimers

Grada is provided by an independent developer free of charge, "as is" and "as available". To the extent permitted by law, we do not guarantee that the App will be uninterrupted, error-free, or that your content will never be lost. Please keep your own copies of photos that matter to you.

15. Liability

• We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body, or health, and under mandatory product-liability law.
• For slight negligence, we are liable only for breach of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible and on which you may regularly rely), and then only for foreseeable damage typical of this kind of contract.
• Any further liability is excluded. Nothing in these Terms limits rights that you have as a consumer under mandatory law.

16. Apple App Store terms

Because Grada is distributed through the Apple App Store, the following also applies:

• These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims.
• You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You must also comply with Apple's App Store Terms of Service and any applicable third-party terms (for example, your mobile carrier's).

17. Governing law and disputes

• These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
• If you are a consumer residing in another EU country, you also benefit from any mandatory consumer-protection provisions of your country of residence.
• The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. We are not obliged and do not undertake to participate in dispute-resolution proceedings before a consumer arbitration board.

18. Changes to these Terms

We may update these Terms from time to time, for example when we add features or when the law changes. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the App. If you continue to use Grada after the changes take effect, you accept the updated Terms. If you do not agree, you can stop using the App and delete your account.
